The prior charges included each of the following: 
            1983-   Alcohol Concentration .10 or more (DWI)
            1988-   Aggravated Violations Gross Misdemeanor
            1991-   Aggravated Violations, Alcohol Concentration .10 or more, Alcohol Concentration .10 or more within 2 hours, Driving Under the
Influence, Drive of Revocation, Drive Contrary to Limited License, Open Bottle, Equipment Violation
            1995-   Driving Under the Influence, Refuse to Submit to Test, Driving after Cancellation, Implied Consent
            1999-   Aggravated Violation, Refusal to Submit to test, Driving Under the Influence of Alcohol, Driving after Cancellation
            2003-   Speeding
            2005-   2nd Degree DWI- Alcohol, Traffic DWI- Operate Motor Vehicle- Alcohol Concentration .10 Within 2 hours, Driving After
​ Cancellation- Inimical to Public Safety, Open Bottle, Drive around Barricade
            2006-   Driving After Cancellation
            2007-   Driving After Cancellation
            2008-   Traffic- DWI- Refuse to Submit to Chemical Test, Traffic- DWI- Operate Motor Vehicle under the Influence of Alcohol, Traffic- DL-
Driving After Cancellation- Inimical to Public Safety At the time of the drunk driving crash the drunk driver was driving on a restricted
license in a vehicle with special license plates for drunk driving offenders. The damages caused by the drunk driver due to his
​ careless behavior were unforgivable. It actually constituted severe criminal conduct.
The conduct of the drunk driver was to so blatantly reckless that it was reported in 
an article in the Minneapolis Star Tribune, which stated the following:

“A man arrested Sunday on suspicion of drunken driving in Minneapolis blew a .391
in a preliminary breath test, according to police. [Drunk Driver] would have had to drink 17 drinks in one hour to get to a .391, according ​
to alcoholhelpcenter.net. Minnesota’s blood alcohol limit is .08”

The drunk driver had multiple alcohol related offenses dating back to 1983. The
​same Star Tribune Article stated

​[Drunk Driver], who has had 10 tickets for alcohol related traffic offenses going back to 1980, has a restricted license that forbids consumption of alcohol.

Cases


Drunk Driver More Than 5 times Above The DWI Limit with a History of Multiple Alcohol Related Offenses: The drunk driving victims, including a driver and two passengers, were struck in a T-bone collision by a drunk driver as he drove
his vehicle through a red light at a high rate of speed.

​The conduct of the drunk driver was particularly egregious in that he was charged
with each of the following:

1.     Traffic DWI- Second Degree Driving While Impaired;
Refuse to Submit to Chemical Test

2.     Traffic DWI- Second Degree Driving While Impaired; Two
​ or More Aggravating Factors

​ 3.     Drivers’ Licenses- Driving Restrictions- Alcohol/
​ Controlled Substance Violations
